USA Unattended operation on 40m...question about auto-qsy scheduling

Hi all - I need an elmer's response on a question. I am in USA; Wisconsin.


I want to leave my station on full-time with VARAC, and I want to stay within the FCC rules about unattended operation. I want to have it on 20m during the daytime hours and auto switch to 40m in the evening hours. I want to use the "Frequency Scheduler" feature of VARAC to manage this.


Am I correct in my understanding that I need to edit the default VarAC_auto_qsy_allowed_frequencies.conf file and edit the line for 40m to something like: "7.100.000-7.105.000" to stay within FCC rules regarding unattended operation?


Below is what I've found in FCC Part 97.221 regarding unattended operation.

FCC says:

FCC Part 97.221

FCC Part 97.221 outlines the regulations for automatically controlled digital stations in the amateur radio service. This section specifies the conditions under which these stations can operate without a control operator present.


Key Provisions

Automatic Control: Stations may operate automatically while transmitting specific types of emissions, such as RTTY (Radio Teletype) or data emissions.

Authorized Bands: The operation is permitted on designated amateur radio bands, including:

6 meters or shorter wavelengths

Specific frequencies within the 28.120-28.189 MHz, 24.925-24.930 MHz, 21.090-21.100 MHz, 18.105-18.110 MHz, 14.0950-14.0995 MHz, 14.1005-14.112 MHz, 10.140-10.150 MHz, 7.100-7.105 MHz, and 3.585-3.600 MHz segments.

thanks for your reply - I do appreciate your time and help.


My understanding is that automated unattended operation of VARAC is not allowable on 40m by USA-licensed operators except between 7.100 and 7.105MHz. Do you agree?
